Energy Performance Certificates (EPC)

What is an Energy Performance Certificate?
An EPC is a document which shows the energy efficiency and carbon emissions of a property. The property is given a rating between A and G and this is displayed on a chart which looks very similar to the energy rating given to domestic appliances such as fridges and washing machines.

Who needs one?
From 4th January 2009, all landlords who wish to let their property must have an EPC. landlords will be required to make an EPC available to tenants at the outset of a new tenancy. Any landlord who does not provide an EPC may be guilty of committing a criminal offence and could incur a fine of up to £5,000.

How much will it cost?

EPC’s normally cost approx. £69.00 + VAT per dwelling.

Periodic Inspection Reports (PIR)

What is a Periodic Inspection Report (PIR)?
It is an in-depth inspection of the electrical installation, producing a six-page Report detailing recommendations and remedial work required. The Periodic Inspection is the most detailed inspection of the electrical installation and ensures functionality and safety.

I'm a Landlord. Why do I need one?
The Consumer Protection Act 1987 dictates that if a landlord supplies an electrical installation in let accommodation. The property should be checked before it is offered for rent. The Consumer Protection Act affects all persons who let property in the course of their business because it defines them as suppliers as they supply goods to the tenant. There are several items of secondary legislation under the umbrella of the Consumer Protection Act that are directly relevant to the supply of electrical goods. Failure to comply with the Electrical Regulations may constitute a criminal offence under the Consumer Protection Act 1987 that carries a maximum penalty on summary conviction of a £5000.00 fine and/or six months imprisonment.

Portable Appliance Testing (PAT)

What is a PAT test?
A Portable Appliance Test or PAT, in the United Kingdom is a process by which electrical appliances are routinely checked to see whether they are safe. The correct term for the whole process is In-service Inspection & Testing of Electrical Equipment. When people work with electrical appliances, health and safety regulations say that the appliance must be safe. Many types of equipment require testing at regular intervals to ensure continual safety; the interval between tests depending on both the type of appliance and the environment it is used in. In the UK, the resulting evidence of Portable Appliance Testing (commonly known as PAT Testing or PA Testing) is clearly visible to tenants in the form of 'Passed' , 'Tested For Electrical Safety' and 'DO NOT USE after' labels affixed to various parts of the electrical equipment they use.

I'm a Landlord. Why do I need one?
The Consumer Protection Act 1987 that impose a statutory duty on landlords to ensure that all electrical equipment supplied by them is safe for use by the tenant.
This Act of Parliament affects all persons who let property in the course of their business because it defines them as "suppliers", i.e. they are supplying goods to the tenant. Failure to comply with the Electrical Regulations may constitute a criminal offence under the Consumer Protection Act 1987, which carries a maximum penalty on summary conviction of a £5,000 fine and/or 6 months imprisonment. Landlords and letting agents could also be sued in Civil Law under the duty of care for failure to ensure the tenants safety and, as a result, face punitive damages.

Gas Safety Certificates (GSC)

What is a Gas Safety Certificate?
A Gas safety certificate is a certificate that is required by law to be held for all rental accommodation in the UK where there are gas appliances present. The requirement is enshrined in the Gas Safety (Installation and Use) Regulations 1998. Every year about 30 people die from carbon monoxide poisoning caused by gas appliances and flues which have not been properly installed or maintained. Many others also suffer ill health. The Gas Safety (Installation and Use) Regulations 1998 specifically deal with the installation, maintenance and use of gas appliances, fittings and flues in domestic and certain commercial premises. They place duties on landlords to ensure that gas appliances, fittings and flues provided for tenants’ use are safe.

Gas safety certificates are made out by CORGI registered technicians.

I'm a Landlord. Why do I need one?
You are required by law to ensure gas fittings and flues are maintained in a safe condition. Gas appliances should be serviced in accordance with the manufacturer’s instructions. It is recommended that they are serviced annually unless advised otherwise by a CORGI-registered installer. You must ensure an annual safety check is carried out on each gas appliance/flue. Before any new lease starts, you must make sure that these checks have been carried out within one year before the start of the lease date, unless the appliances in the property have been installed for less than 12 months, in which case they should be checked within 12 months of their installation date.

What happens if I don’t maintain my tenants’ gas appliances?
Failure to do so may result in loss of life. Not only that, you risk being prosecuted, and this could result in you facing a maximum penalty of £5000 for each offence. If the case is then referred to the Crown Court the maximum penalty may be an unlimited fine and the possibility of imprisonment.
